Terms of Service

1. Definitions

  • "Account" means a registered user account on the Service.
  • "Badge" means the visual "Stamped ✓" verification image generated by the Service.
  • "Content" means any file, document, image, audio, video, code, or other digital material submitted to the Service for timestamping.
  • "Hash" means the SHA-256 cryptographic fingerprint generated from your Content.
  • "Stamp" means a single blockchain timestamp transaction processed through the Service.
  • "Subscription" means a paid plan providing access to the Service's features.
  • "Verification Page" means the publicly accessible page at iostamp.com/verify/ that displays timestamp proof.

2. Account Registration

2.1. To use certain features of the Service, you must create an Account by providing a valid email address and any other required information.

2.2. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.

2.3. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an Account.

2.4. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

2.5. IOStamp reserves the right to suspend or terminate any Account that violates these Terms.

3. Description of the Service

3.1. IOStamp provides blockchain-based timestamping services that allow users to create a permanent, tamper-proof record proving that specific digital content existed at a particular point in time.

3.2. The Service operates as follows:

  • (a) You submit a cryptographic hash (SHA-256) of your Content to our API.
  • (b) IOStamp anchors that hash to the Bitcoin SV (BSV) blockchain.
  • (c) The Service returns a transaction ID, timestamp, and verification URL.
  • (d) A visual Badge may be generated client-side in your browser.

3.3. Your Content never leaves your device. Only the cryptographic hash — a mathematical fingerprint — is transmitted to and processed by IOStamp. We do not receive, store, view, or have access to your original files.

3.4. IOStamp does not provide legal advice, notarization services, or copyright registration. The Service provides evidence of existence at a point in time, which may be used to support legal claims at your discretion.

4. Subscriptions and Payments

4.1. The Service offers free and paid Subscription plans. Current plans, pricing, and features are listed at iostamp.com and may change with prior notice.

4.2. Paid Subscriptions are billed in advance on a monthly or annual basis, depending on the plan selected.

4.3. All payments are processed through Stripe, Inc. By subscribing, you agree to Stripe's terms of service in addition to these Terms.

4.4. Subscription fees are non-refundable except as required by applicable law. You may cancel your Subscription at any time, and it will remain active until the end of the current billing period.

4.5. IOStamp reserves the right to modify pricing with at least 30 days' notice. Existing Subscriptions will not be affected until their next renewal date.

4.6. If payment fails, IOStamp may suspend access to paid features. Your data (hashes and metadata) will be retained for 90 days, after which it may be deleted.

4.7. Promotional discounts and coupon codes are subject to specific terms communicated at the time of offer and may be limited in duration, availability, or eligibility.

5. Free Tier and Stamp Allocation

5.1. New Accounts receive a one-time allocation of free Stamps as specified at the time of registration.

5.2. Free Stamps do not expire but are non-transferable and have no cash value.

5.3. IOStamp reserves the right to modify or discontinue the free tier at any time with reasonable notice.

6. API Usage

6.1. Paid Subscribers receive API access subject to the rate limits and usage quotas of their Subscription plan.

6.2. You agree not to:

  • (a) Exceed the rate limits of your plan.
  • (b) Share, sell, or redistribute your API key.
  • (c) Use the API to build a competing timestamping service.
  • (d) Reverse engineer, decompile, or attempt to extract the source code of the API.
  • (e) Use the API in any manner that could damage, disable, or impair the Service.

6.3. IOStamp may throttle or suspend API access if usage patterns indicate abuse or violate these Terms.

7. Badges and Verification

7.1. Badges are generated client-side in your browser using data from the Service. IOStamp does not store Badge images.

7.2. You may use, display, share, and embed Badges generated by the Service in connection with your Content for personal, commercial, or promotional purposes.

7.3. You may not alter, modify, or forge the verification data within a Badge to misrepresent the timestamp, hash, or blockchain transaction.

7.4. White-label Badge customization is available on applicable Subscription plans as described on our pricing page.

7.5. Verification Pages are publicly accessible. Any person with the verification URL or hash can verify a timestamp independently.

8. Intellectual Property

8.1. IOStamp retains all rights, title, and interest in and to the Service, including its software, API, design, trademarks, and documentation.

8.2. You retain all rights to your Content. IOStamp claims no ownership over any Content you submit or timestamp through the Service.

8.3. By using the Service, you grant IOStamp a limited, non-exclusive license to process your Hash for the purpose of providing the Service. This license does not extend to your original Content, which we never receive.

8.4. The IOStamp name, logo, "Stamped ✓" badge design, and #StampBeforeYouPost are trademarks of IOStamp LLC. You may not use these marks in a manner that suggests endorsement by IOStamp without prior written consent, except as part of Badges generated through legitimate use of the Service.

9. Acceptable Use

9.1. You agree not to use the Service to:

  • (a) Violate any applicable law, regulation, or third-party rights.
  • (b) Timestamp content that you do not own or do not have the right to timestamp.
  • (c) Engage in fraud, deception, or misrepresentation.
  • (d) Attempt to falsely prove ownership of content you did not create.
  • (e) Submit hashes at a volume or frequency designed to disrupt the Service.
  • (f) Facilitate illegal activities or the distribution of harmful content.

9.2. IOStamp reserves the right to investigate violations and may suspend or terminate Accounts that breach this section.

10. Blockchain and Third-Party Services

10.1. Timestamps are anchored to the Bitcoin SV (BSV) blockchain, a public, decentralized network not owned or controlled by IOStamp.

10.2. IOStamp does not guarantee the continued operation, availability, or security of the BSV blockchain or any third-party blockchain network.

10.3. Once a hash is anchored to the blockchain, it cannot be modified or deleted by IOStamp or any other party. This is by design and is a core feature of the Service.

10.4. IOStamp is not responsible for any changes to blockchain protocols, forks, network disruptions, or third-party explorer availability that may affect the display or verification of timestamps.

11. Disclaimers

11.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2. IOStamp does not warrant that:

  • (a) The Service will be uninterrupted, error-free, or secure.
  • (b) Timestamps will be accepted as evidence in any specific legal proceeding.
  • (c) The BSV blockchain will remain operational or unchanged.
  • (d) Badges or Verification Pages will be available indefinitely.

11.3. IOStamp is a technology provider, not a law firm, notary, or copyright office. Use of the Service does not constitute legal advice or legal protection. Consult a qualified attorney for legal matters.

12. Limitation of Liability

12.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IOSTAMP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

12.2. IOSTAMP'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO IOSTAMP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12.3. These limitations apply regardless of the theory of liability, whether in contract, tort, negligence, strict liability, or otherwise.

13. Indemnification

13.1. You agree to indemnify, defend, and hold harmless IOStamp LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • (a) Your use of the Service.
  • (b) Your violation of these Terms.
  • (c) Your violation of any third-party rights.
  • (d) Any Content you submit or claim ownership of through the Service.

14. Termination

14.1. You may terminate your Account at any time by contacting us at hello@iostamp.com or through your Account settings.

14.2. IOStamp may terminate or suspend your Account at any time for violation of these Terms, with or without notice.

14.3. Upon termination:

  • (a) Your access to paid features will cease immediately.
  • (b) Existing blockchain timestamps remain on the public blockchain permanently and are not affected by Account termination.
  • (c) IOStamp may retain your Hash data and metadata for a reasonable period as required by law or for legitimate business purposes.

15. Changes to These Terms

15.1. IOStamp may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date.

15.2. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15.3. If you do not agree with the updated Terms, you must stop using the Service and terminate your Account.

16. Governing Law and Dispute Resolution

16.1. These Terms are governed by and construed in accordance with the laws of the State of DELAWARE, United States, without regard to its conflict of law principles.

16.2. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be resolved through binding arbitration under the rules of the American Arbitration Association.

16.3. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. Miscellaneous

17.1. Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and IOStamp concerning the Service.

17.2. Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3. Waiver. Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4. Assignment. You may not assign these Terms without IOStamp's prior written consent. IOStamp may assign these Terms without restriction.

17.5. Force Majeure. IOStamp shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, blockchain network failures, or government actions.
